Being that 90% of Floridians use groundwater, coming from the aquifer, fracking poses a specific problem in Florida. The Energy Policy Act of 2005 stripped the Environmental Protection Agency of its authority to regulate fracking at the behest of the oil and gas industry. The Act explicitly exempted fracking operations from key provisions of the Safe Drinking Water Act. This means unbridled air, water, and land pollution goes unchecked without legal recourse, and Florida legislators want to prevent this from happening before it even begins.
